Azerbaycan Hukukunda, evlenme, kadın ve erkeğin aile kurmak amacı ile
kanundaki şartlara uyarak yetkili devlet organı memurunun huzurunda karşılıklı
ve bir birine uygun irade beyanları ile yaptıkları ve yetkili devlet organı tarafından
aile kütüğüne tescil edilmiş kendine has bir yapısı olan bir sözleşmedir.
Bununla birlikte, Kanun Koyucu istisna durumlarda resmi şekil şartına uyulmadan
yapılmış evlenmenin, yani fiili evlenmenin de geçerli bir evlenme olduğunu
kabul etmiştir. İster resmi olarak tescil edilmiş olsun isterse de fiili evlilik olsun
tarafları için hukuki, ahlaki, dini, sosyal, psikolojik, fizyolojik, ekonomik sonuçlar
doğurmaktadır. Şunu belirtmek gerekir ki, Azerbaycan Hukukunda evlenme
sonucu oluşan ailede kadın ve erkeğin hukuki konumu eşitlik ilkesi gereğince
düzenlenmiştir.
