1980 tarihli Milletlerarası Mal Satımı Sözleşmeleri Hakkında Birleşmiş Milletler
Antlaşması, 1 Ağustos 2011 tarihi itibarıyla ülkemiz için yürürlüğe girmiş-
tir. Dolayısıyla, söz konusu Antlaşma, kapsamına giren satım sözleşmeleri ve
düzenleme konusu yaptığı meseleler hakkında, bir iç hukuk kuralı olarak uygulanmaktadır.
Bu durum, bu Antlaşma’nın uygulama alanının sınırlarını doğru bir
şekilde tespit etmeyi zorunlu kılar. Bu düşünceden hareketle hazırlanan bu
çalışmada, Viyana Satım Konvansiyonu’nun uygulama alanı çeşitli yönlerden,
özellikle kişi ve yer yönünden, konu yönünden ve zaman yönünden ele alınmış-
tır. Ayrıca Antlaşma’nın uygulanmasını etkileyen birer unsur olarak, Antlaş-
ma’da taraf iradelerine verilen önem, Antlaşma’nın uygulanmasının çekince ile
engellenmesi imkânı ve Antlaşma’nın otonom yorumlanması ilkesinden söz
edilmiştir. Bu suretle, söz konusu antlaşmanın uygulama alanına ilişkin ana yapı
bu çalışma ile ortaya konulmaya çalışılmıştır.

The 1980 UN Convention on the International Sale of Goods (CISG) is an
international convention that has entered into force as of the date of 1
August 2011 for our country. Therefore, this convention has applied to sales contracts that are included in the scope of the convention and to the issues
made under examination at the convention as a national law. This situation
necessitates to determine the limits of scope of application of this
convention accurately. Starting from this, the scope of application of Vienna
Sales Convention has been analyzed from various aspects, particularly from
the point of person and place and from the point of time. Also as a factor
affecting the implementation of the convention, the importance of the
intention of the parties at the convention, the prevention facility of the
implementation of the convention with a reservation and the principle of
autonomous interpretation have been mentioned. In this way, the main
structure concerning the scope of application of this convention has been
aimed to set forth with this study.
