Ara dinlenmesi işçinin anayasal bir hakkıdır ve kanun ve yönetmeliklerle dü-
zenlenmiştir. En genel tanımıyla ara dinlenmesi; günlük çalışma süresinin ortalama
bir zamanında o yerin gelenekleri ve işin gereğine göre ayarlanmak suretiyle
işçilere tanınan dinlenme hakkıdır. Ancak bu süreler; iklim, mevsim, o yerdeki
gelenekler ve işin niteliği göz önünde tutularak sözleşmeler ile şartlar doğrultusunda
uyarlanabilir. Ara dinlenmeleri kural olarak çalışma süresinden sayılmaz.
Ara dinlemesinin süresi ve kullanım şekli açısından bir takım esasları vardır
ve kullandırılmaması iş sözleşmesinin feshine ya da fazla çalışma veya fazla
sürelerle çalışma bakımından ücrete hak kazanma gibi sonuçlar doğurur.

To have a rest is the kind of right which is have by the workers according
to the Constitution. Relaxation allowance has been recognized as a
fundamental right and is protected in the 1982 Constitution, laws and
regulations. In generally meaning; this is a right which granted to workers by
adjusting it according to the requirements of the work and tradition, an
average time of daily work period. The right that above quoted can adapted by
the conventions under the terms acording to climate, season, traditions and
the nature of the job. Relaxation allowance is not as working time except for
special circumstances.
There are some principles for relaxation allowance like period and usage.
And if not be allowed by the employer, it leads to termination of the
employment contract or earning overtime pay. The rest times which salary is paid by the employer can be counted like
these; week holidays, national holidays and public holidays and paid annual
leave. But the relaxation allowance is different from other rest times which for
workers because of the pay. So relaxation allowance is the subject -that I tried
to research every angle- of my working.
