Osmanlı’nın son dönemi, yaşanan siyasî, sosyal ve ekonomik buhranlar sebebiyle pek çok Fıkhî meselenin tartışıldığı bir zaman dilimi olmuştur. Bu dönemde usûl-i fıkıh ve furû‘ arasındaki etkileşimin de güzel örneklerine rastlanmaktadır. Bu örneklerden birini sunmayı amaçlayan bu makalede, Mansûrîzâde Said Bey’in “Cevaz şer‘î bir hüküm değildir” iddiâsının sâikleri irdelenmiştir.
Giriş bölümünde Mansûrîzâde'nin görüşlerinin hangi şartlarda serdedildiğini anlayabilmek maksadıyla dönemin fikrî ortamına kısa bir bakış yapılmıştır. Mansûrîzâde'nin bu meseleyi ele alış farkını göstermek adına birinci bölümde klasik usûl literatüründe problemin nasıl işlendiğine yer ver verilmiştir. İkinci bölümde, Mansûrîzâde'nin ilmî kişiliği hakkında kısa bir bilgi verildikten sonra onun cevâzın ahkâm-ı şer‘iyye’den olmadığı görüşüne açıklık getirilmiştir. Yine bu bölümde, Mansûrîzâde'yi bir usûl problemini tekrar gündeme taşımaya sevkeden âmiller sıralanmıştır. Sonuç kısmında Mansûrîzâde'nin bir usûl problemini, güncel bazı furû‘ problemlerinin çözümü için kullanmasının, fıkıh tarihinde usûl-furû‘ etkileşimi açısından dikkate değer bir örnek olduğu neticesine ulaşılmıştır.

Because of the politic, social and economic crises, the last years of Ottoman have been a time period that many fiqh issues were disscussed in. Also in this period, it is found good examples of usûl-furû‘ (theory-practise) interaction. In this article that aims to provide one of these examples, the underlying reasons of Mansurizade Said’s view that “The permissibility/al-ibâhah is not a legislative rule”, have been examined.
In order to understand that Mansurizade’s views emerged on what conditions, a brief overview of intellectual situation of the period was offered in the introduction section. To demonstrate Mansurizade’s difference in handling of this issue, in the first section it was presented how the problem was addressed in the classical usûl literature. In the second section, after giving a brief about Mansurizade’s scientific personality, his opinion of permissibility was clarified. Likewise in this section, the factors led him to put a theoretical (usûl) problem back on the agenda again were listed consecutively. In the result section, it has been reached that Mansurizade’s handling an usûl issue to solve some current furu‘/practical problems is a remarkable example of Usul-furu‘ interaction in the history of fiqh.
