Статья посвящена освещению одной из актуальных процессуально-правовых проблем хозяйственного права по вопросу правового основания представительства прокурором интересов гражданина или государства в суде. Поскольку действующее законодательство недавно претерпело значительные изменения надо рассмотреть совершенно новый подход к допуску прокурора к участию в деле, а именно: из-за необходимости обоснования последним наличия оснований для представительства именно им интересов гражданина или государства в суде, а не истцом самостоятельно.

The article is devoted to the coverage of one of the actual procedural and legal issues of economic law regarding the legal basis for the representation of the interests of a citizen or state in the court by the prosecutor. As the current legislation has recently undergone significant changes, a completely new approach should be considered to allow the public prosecutor to participate in the case, namely: due to the need to justify the latter availability of grounds for representing the interests of a citizen or a court in court, and not on the plaintiff alone.
