В статье автором исследованы основные доктринальные позиции касательно существования права на превентивную самозащиту до вооруженного нападения. Вопрос раскрывается сквозь призму позиций выдающихся ученых в сфере международного права и практики Международного Суда ООН. Статья обращает внимание на нынешние проблемы в практике между государствами. Отмечены все возможные аргументы, которые поддерживают и опровергают возможность существования данного права. Автором предоставляется ответ по этому вопросу.

In the article, the author analyses the main doctrinal positions concerning the question of the existence of right to preventive self-defense. This question is described through the lens of teachings of the most highly qualified publicists in the sphere of international law and practice of the International Court of Justice. Article brings attention to modern problems in state practice. It points out all possible arguments, which support or disapprove the possibility of existence of such right. The author provides an answer to this question.
